The law firm of Flaherty McCarthy LLP has commenced three (3) multi-million dollar Class Actions against three Ontario lawyers (VIKTOR HOHOTS, JOSEPH STEPHEN FARKAS and ERZSEBET JASZI) who negligently represented members of the Roma community. The Plaintiffs and Class Members in each of these three related claims retained the Defendants to represent them at Immigration and Refugee Board hearings.
These actions are brought on behalf of the Plaintiffs in their own right, and pursuant to the Class Proceedings Act, 1992, S.O. 1992, c.6 on behalf of all persons resident in Canada or abroad who were refugee claimants from Hungary who were negligently represented by the Defendants and who thus lost the opportunity to have their refugee claims heard on the merits, due to the Defendants (i) inappropriately delegating professional responsibilities and abdicating his professional responsibilities; (ii) failing to complete and file Personal Information Forms (“PIFs”) with supporting evidence; (iii) completing or filing manifestly inadequate and/or incorrect Personal Information Forms (“PIFs”) with supporting evidence; (iv) failing to appear at Hearings; or (v) failing to arrange for translation services for meetings or hearings as needed.
At this point, these matters are proposed class proceedings. As a class member, you do not have to do anything more to be involved in this lawsuit. You will be a member of the class until you are given the opportunity to opt out, which will be your choice.
